Ninestar Wins Patent Dispute Again in China

On December 14, the Fuzhou Intermediate People’s Court has issued a final determination in favour of Ninestar over a patent infringement dispute.

On October 7, Ninestar filed a lawsuit to the Fuzhou Intermediate People’s Court, alleging that MC-CC388A, MC-Q2612A and MC-CRG303/MC-Q2612X high-yield refillable printer cartridges from Fuzhou Sixi Digital Technology Co., Ltd and Shanghai Luochen Digital Technology Co., Ltd infringed its patent (Patent No. ZL200810218032.3).

As ruled, the two defendants should cease to produce, sell the accused products effective from the issuance, and destroy stocks if any. In addition, Fuzhou Sixi Digital Technology Co., Ltd shall compensate Ninestar a total of RMB 400,000 (USD$61,263) for economic losses and reasonable expenses incurred to stop the infringement.

Previously, Ninestar successfully safeguarded its inkjet cartridge patent rights in the patent dispute with Zhongshan Yuzhe Company.

As a result, Zhongshan Yuzhe has fully acknowledged the validity of Ninestar’s related patents and admitted that a series of its products infringed several of Ninestar’s patents in China and Japan. The company also agreed to pay Ninestar an undisclosed amount of damages.

As a leader in intellectual property rights, Ninestar claims it has invested heavily in R&D and technological innovation. On this basis, it has developed and accumulated a hard-won patent portfolio. Over recent years Ninestar has spared no effort to defend its patent rights.
